Terms of Service

PROPERTY READINESS:

The Client is expected to have the property “camera-ready” prior to the beginning of the arrival window. This includes all cleaning and furniture staging.

We ask that you have your clients review our Getting Ready checklist

If the Photographer arrives at the appointment and the home is not ready, the property will be shot “As Is”.

We value your feedback and input for choosing the best angles to photograph the property. If you would like to give input, please meet the photographer at the beginning of the appointment or add notes in the “comments” section of the order.

Absent your input, our photographer will use his/her best judgment and experience to decide which angles will best highlight the property.

ORDER ACCURACY AND DETAILS:

The Client is expected to have accurately entered or communicated all pertinent information at the time the order is placed. We reserve the right to update incorrect information and adjust the pricing of the order to accurately reflect the order (ex. The client enters that the property is 1,200 square feet but it is actually 2,400 square feet).

Our pricing reflects the cost for a single dwelling in a residential household. For commercial or multi-unit properties, please contact our office or your Business Development Specialist for a personalized quote.

RESCHEDULE/CANCELLATION POLICY:

Confirmed appointments canceled or rescheduled within 24 hours before the appointment start time are subject to a $50 cancellation fee. If we arrive on-site before the appointment is canceled, it will be subject to a full cancelation fee of $100 Appointments that cannot be completed due to weather issues (ex. Our photographer is unable to fly the drone due to rain/wind, or too heavy of rain to capture exteriors), will be rescheduled after contacting the Realtor and the $50 cancellation fee will be waived. Travel fees will be charged if the photographer arrives on site.

Locking and Securing Property

We are not responsible for locking and securing a property after a photo shoot. Our photographers will do their best to a reasonable level of effort to relock doors and access points, but this is a courtesy service, we do not take responsibility for any unlocked doors or unauthorized access gained through unlocked doors.

Copyright and Licensing

At Whetstone Creative, we understand the importance of copyright protection and value the rights of photographers and other creators. We want to ensure that our clients fully understand the copyright ownership and licensing terms associated with the real estate photos we provide. Please read the following information carefully:

Copyright Ownership:

All real estate photographs taken by our team at Whetstone Creative are protected by copyright law. Copyright ownership remains with the photographer unless otherwise agreed upon in writing. This means that we retain the exclusive rights to reproduce, distribute, display, and license the images.

License for Clients:

We grant our clients a non-exclusive, non-transferable license to use the real estate photos for marketing purposes related to the specific property being photographed. This license allows clients to display the images on their websites, print marketing materials, social media platforms, and other promotional channels.

Limitations on License:

The license granted to clients is limited to the specific property for which the photos were taken. It does not permit the use of the images for any other properties or purposes unrelated to the specific property photographed. Clients may not transfer, sell, sublicense, or grant access to the photos to any third parties without our explicit written consent.

Unauthorized Use:

Any use of the real estate photos beyond the scope of the license granted or without our permission is strictly prohibited. Unauthorized use includes, but is not limited to, using the photos for commercial purposes, selling prints or products featuring the photos, altering the photos without permission, or using the photos for any illegal or inappropriate activities.

Deliverables and Ownership:

Upon payment and completion of our services, we will provide our clients with high-resolution digital files of real estate photos. Clients do not acquire ownership of the photos but have the right to use them as specified in the license agreement.

Exclusivity Add-On:

For clients who wish to have exclusive rights to real estate photos, we offer an exclusivity add-on. This grants clients sole usage rights to the photos, ensuring that the images will not be licensed or sold to anyone else for the duration of the exclusivity agreement.
